Exemptions from overtime requirements are often misunderstood.  Some employees are classified as exemption when they should not be  The Fair Labor Standards Act (FLSA) permits Executive, Administrative, Professional, Outside Sales and some Computer employees to be exempt from overtime requirements of the law if they have clearly defined duties and responsibilities.   We  direct our clients to clearly define job descriptions in writing and follow these descriptions in practice. Hourly employees, if paid following our advice, can also be exempt from the overtime provisions of the Wage and Hour Law.
