Funding Your Trust
Do you have a trust? If so, are you certain that the ownership of all your assets has been transferred to your trust? This transfer of ownership does not happen just because you have a trust. In order to take advantage of your trust documents, you must take the time to re-title your assets to your trust, or all or part of your estate may still end up in Probate Court. At Zeigler and Associates, our services include the complete funding, re-titling and asset transfers to our clients’ trusts. Our clients can elect to have us complete all of the funding or we will advise and direct them on how to complete this very important task.
At Zeigler and Associates, the most common pattern we see among clients with a trust is that only a few of their assets have been re-titled into the name of their trust. When this happens, assets (such as savings and checking accounts, CDs, stocks, bonds and brokerage accounts, real estate titles, etc.) still titled in the individual’s name alone on death, will go through the expensive Probate Court process. The will and trust documents will instruct the Probate Court which person will receive the assets, but the Probate Court is the only entity with the power to re-title and transfer the assets should the individual fail to act during their lifetime. Our clients retain our firm to completely avoid the time and expense of Probate Court.
